The road from ‘victim’ to starfighter, campaigner, McKenzie Friend and Advocate, Litigant’s Friend or Public Interest Advocate is paved with LOTS of shocks as ‘waking up therapy’ or ‘truth emergency’ as Global Research calls in this recent article.

This website is an admirable ‘fledgling resource’ – with the following ‘take away messages’:

1. we need Friends to ‘process’ the shocks we’re experiencing, as we’re waking up to the fact that the authorities are NOT here to help
2. we need to know what is our REMEDY, i.e. which legal form needs to be sent to which authority; the library of forms is here
3. the most effective process is a Judicial Review in your local County Court, for £25.
4. In practice, we need
   • C100 to apply for CONTACT with our kids
   • N244 to apply for ANY kind of ORDER
   • an Appellant’s Notice, if we want to APPEAL an Order
   • N461 to apply for a Judicial Review.

This means we now have to learn to help each other writing Judicial Reviews. It implies using LEGAL ARGUMENTS and often referring to ‘precedent cases’.

4. attending a ‘Directions’ hearing in the Royal Courts of Justice
5. reminding Social Services to comply to the order made
6. learning to use Google docs to co-author a ‘skeleton argument and amended grounds for appeal’ and submit it in time
7. getting ready for a hearing about the Permission to Appeal
8. visiting Social Services who had not complied to the Order
9. producing a ‘Position Statement’ – just in case – for ‘the other side’ were going to produce something…
10. submitting the McKenzie CV and asking for ‘right of audience’ which was granted. [Since it's up to the discretion of the judge, one never knows...]

The mother came out crying with, I presume a mix of joy and relief, for “she got it”: the permission to appeal. The Appeal will be heard in nearly 3 months: in May 2013.

The key is the precedent case made by Judge Munby, the current President of the Family Division who had said [para 44, iv]

to take a baby at birth is a dreadful thing: dreadful for the father, the mother and the baby…

It refers to this case in the Court of Human Rights in Strasbourg which emphasised at paras [116], [131], [133],

that the removal of a child from his mother at or shortly after birth is a “draconian” and “extremely harsh” measure, requiring “exceptional justification” and “extraordinarily compelling reasons” under Article 8.

Globalisation strategist Zbigniew Brzezinski[1] recently identified accelerating social change driven by “instant mass communications”, which have been cumulatively stimulating “a universal awakening of mass political consciousness[2].” In the UK, the consequent gulfs between public opinion and government, and between online and mainstream media are widening precariously: poll after poll details public trust plummeting[3][4][5] all round while many political activist websites have grown as busy as mainstream e-commerce and media outlets.

As public interest advocates, the Association of McKenzie Friends seeks to acknowledge and address these gaps as a matter of urgency. In the wake of debilitating systemic failures such as Hillsborough, Savile and Leveson, we will be presenting an evidence-based analysis of “Seven Deadly Syndromes” that infect public life. Panel members are:

Hillsborough[21] and, amongst others, the cases of Michael Doherty[22] and Tony Farrell[23] highlight ongoing police failings and corruption; requests for a public inquiry into 7/7 go ignored. Savile[24] and other paedophile exposes continue to implicate our care system; schools; churches; prisons; hospitals; Westminster; royalty, decimating public confidence. The NHS is failing our vulnerable. Protests continue as public awareness increases about: secret family courts; Common Purpose; austerity cuts; student loans; the banking system; state surveillance; Israel – all seemingly unheard by government and ignored by mainstream media. This deplorable state in mind, the McKenzie Friends are appealing to all public servants who embrace seven principles of public life to come forward and stand together in the form of “advocates of integrity”:

In an effort to address and take responsibility for UK society’s collective sickness, the McKenzie Friends are calling upon employees at all levels of public institutions, whether Local Authorities, police, NHS, educators, civil servants, judiciary or other, to come forward as advocates of the Seven Principles. UK society does not need “rescuing” or “watching over” by those who refuse to stand open and accountable: we need our individual members – you – to step into self-responsibility and courageous outspokenness; we need our individual members – you – to protect our citizens and families, our neighbours, communities and, above all, our most vulnerable from the effects of what now amounts to an epidemic of secrecy, corruption, perversion and fear.

Today

1. we need to decide whether the person is fit enough to be in court or requires some counselling, before representing themselves as a Litigant in Person
2. we need to produce a chronology of the case as a summary for trained legal professionals
3. we need to decide on the desired outcome of the legal remedies and procedures available.

Together, we have experienced a long list of ‘malpractice’. We are therefore determined to improve our competence such that we can confront a system of paid professionals that is far too overwhelming to tackle on our own.

We’ve now got a good Steering Group and some people even believe that we’re on to a winner!…

BACKGROUND
People recently have been informing me of difficulties they have had while helping friends who may be facing Court action, with being recognised by the Court, as normally Court Magistrates and Judges are used to dealing with people who they term as Lawyers,

Wikipedia legal definition;

In England and Wales, “lawyer” is used loosely to refer to a broad variety of law-trained persons. It includes practitioners such as barristers, solicitors, legal executives and licensed conveyancers; and people who are involved with the law but do not practise it on behalf of individual clients, such as judges, court clerks, and drafters of legislation.

When playing my small part in the campaign to free Norman Scarth, one of my roles was that I acted as McKenzie friend in Court, which in real terms meant I actually took on the role of a Barrister and Solicitor combined, in that I filled out all the forms and created multiple copies of relevant paperwork, including evidence and dealt with communication to and from the Court and was even granted Legal visits to Norman Scarth in the Prison, going as far as applying for permission to take a tape recorder in, which permission was granted for.

I am not a legal professional, nor do I have any formal qualifications. I am self taught, driven by a desire to correct the inequality within the justice system.

Before this application was made, any application for a Writ has been made by very senior practising Lawyers who specialise within the High Court.

On the 25 August 2011, all that changed as it was written in to case Law that the rights of the common Law advocate remain, and are reasserted under the ever evolving status of ‘McKenzie friend’.

No application was made for rights of audience to address the judge, but it was simply granted.

The matter sat in both Civil and Criminal jurisdiction within the High Court of Justice (see paragraph 22) meaning this case Law has implications for every Civil and Criminal hearing at regional and national level.

WHAT THIS MEANS TO YOU

Legal Maxim “He who fails to assert his rights has none.”

This asserts in Law that any man or woman may have any representation of their own choosing and that representation does not have to be a recognised Lawyer or indeed have any qualifications.

Therefore if you wish to assist a friend in Court you may quote the above case Law, copy, paste and print, with its reference, and submit this to the Court in writing at the outset of proceedings.

The case law grants the McKenzie friend rights of audience in all matters whether Civil or Criminal proceedings.

The case law also established the right to make informal on the spot applications by the McKenzie friend.

It is your duty to assert your rights in this way, as it makes it easier for the next man or woman.

This way the judiciary gets used to doing things fairly again.

Judiciary Guilty of Criminal Acts

John Hemming MP opens 2-week demo at Royal Courts of Justice

The Campaign for Truth and Justice[1] is staging a demonstration every day from 9.30am to 4.30 to, once again, highlight the plight of victims of miscarriges and perversion of justice. On its home page, the Campaign spells out in general terms what Victims Unite[2] publishes by way of Cases as Stories[3]: unlawful imprisonments, human rights abuses, fraudulent bankruptcies and child snatching[4] as the tip of an iceberg of white collar crimes, where the Judiciary covers up the crimes committed by public authorities such as the NHS, Local Councils, their legal teams and Social Services.

John Hemming MP[5] has ample experience with parents whose children were taken: he says that the evidence is that about half of his over 1,600 cases on file are unreliable. In 2006, 200 such parents ended up as Secret Prisoners[6], for they are convicted in secret family courts. But it can be worse: their are secret prisoners whose legal capacity to decide has been removed from them by the Court of Protection – only to defraud them of their wealth and assets. John Hemming MP will join the demonstrators around 3.30pm.

Caul Grant[7], the founder of the Campaign, lost his son to the negligence of the NHS. But since he didn’t get any acknowledgement or apologies, he felt compelled to provoke the system and eventually got falsely imprisoned for six and a half years, which he used to study the law. As a result, he has been successfully representing himself as a Litigant in Person, which many victims have to revert to, given the corruption they experience among the legal profession.

Evidence can be found on Solicitors from Hell[8] as well as under Legal Mafia Evidence[9] on Victims Unite.

As a self-help measure in the absence of the Rule of Law, the Association of McKenzie Friends[10] was launched on 6^th March 2012, to assist Litigants in Person, especially when they end up as innocent prisoners. Besides John Hemming MP, Austin Mitchell MP[11] supported the event and offered to write to all Members of Parliament.

However, this turned out to uncover more challenges:

1. McKenzie Friends of Litigants in Person ought to have legal visits in prison to take papers in and out, but have been refused in HMP Pentonville, HMP Holloway and HMP Cardiff.
2. Similarly, McKenzie Friends were not allowed to speak to the prisoners in court cells in preparation of hearings.
3. Prisoners such as Maurice J Kirk BVSc[12], Bishop Gloria Musa[13] and Reverend Joseph Musa are held as political prisoners, with varying sheets of charges, questions over MAPPA registration (classification as terrorists as dangerous as the top5% of the population) and the complete impossibility to defend adaequately from inside.
4. Instead of prisoners being treated as “innocent until proven guilty”, they are experiencing seriously bad treatement such as being called “black monkey” and “black criminals” as well as physical assault, refusal of bail on the most spurious of grounds and restrictions of telephone and mail that cannot relate to either the Rule of Law, justice, human or prisoners’ rights.

The Association of McKenzie Friends is thus supporting the demo, especially on the day that the Musas whose six children were taken in April 2010, will ask for an adjournment. Their latest legal representation was, once again, far from representing the couple’s interests, let alone those of the children. Christopher Booker wrote already in December 2010 in The Telegraph:

“A council whistleblower has said that, at a recent case conference, the social workers admitted that maybe they had made a mistake, and that the mother they had falsely accused was in fact devoted and blameless. But apparently, because of “press interest” in the case, the officials agreed that the council could not afford the very damaging publicity which might follow if the unhappy children were reunited with their parents. It was therefore vital that the council should continue to justify its actions.”

The Musas are listed to be heard in Court 68 at 2 o’clock, before Lady Justice Black.

1. Maurice J Kirk BVSc will continue his hunger strike: the best known unconvicted political prisoner whose tenacity and fighting spirit can hardly be surpassed
2. The Musas are extremely well known in Africa; hence their public support has helped them somewhat, except it’s not enough to get them out of the clutches of corrupt family and criminal courts, prisons and Haringey Police who are acting just as South Wales Police with respect to covering up mistakes by crimes.

McKenzie Friends are NOT taken seriously by HMP Governors, as can be seen in this letter by HMP Pentonville regarding Joseph Chiwar Musa and by the fact that Maurice cannot telephone me any more as his McKenzie Friend.

Where do we go from here?

• on Monday we’ll start the 2-week demo outside the Royal Courts of Justice advocating Judiciary Guilty of Criminal Acts… especially in Family Courts
• in the evening we’ll meet to brainstorm and grow the network
• I just wrote this email to the Children Minister Tim Loughton MP:

Dear Minister

I can’t tell you how inappropriate your letter to the Daily Mail is, regarding Christopher Booker’s excellent article Children Stolen by the State.

In addition to the rather shocking and convincing statistics published by the Daily Mail already, please note:

1. Ian Josephs publishes Forced Adoptionand has a degree in law. He used to be a local councillor in Kent and has been helping parents over the phone for five years;
   1. With an average of 3 – 4 new phone calls a day that makes some 5,000 “exceptionally rare” cases
   2. John Hemming MP has over 1,600 “exceptionally rare” cases on file and explains how forced adoptions and the secrecy in family courts work – as an evil system and confirms Government pressures and OFSTED ratings
   3. 75 children died whilst in care – as published in 2006
   4. 200 people were sent to prison by the family courts – as Harriet Harman MP said in Parliament in 2006
   5. These six Nigerian children were taken by Haringey Police in April 2010 WITHOUT any paperwork and family courts are simply used for one cover up after another – including those fake ‘expert witnesses’; in fact, Christopher Booker wrote: “A council whistleblower has said that, at a recent case conference, the social workers admitted that maybe they had made a mistake, and that the mother they had falsely accused was in fact devoted and blameless. But apparently, because of “press interest” in the case, the officials agreed that the council could not afford the very damaging publicity which might follow if the unhappy children were reunited with their parents. It was therefore vital that the council should continue to justify its actions.” The parents are held in prison since 29^th November 2011, without bail, on MAPPA as highest level terrorist and under the most bizarre Draconian restrictions, when, in fact, they should be treated as innocent, until found guilty!
   6. The Secrecy of Family Courts should be stopped NOWis an online petition
      1. 893 signatures, 13,740 page views and marvellous comments will show you who has a better “full picture” of what is happening ‘out there’: you or Christopher Booker
      2. The Independent published The untold story of gagging orders in May 2011: at least 264 orders cover children and young adults, whereas 69 protect high profile cases
      3. Child Snatching is the correct word – just as state kidnapping or State Stealing Childrenis:
         1. A world wide protest against child abuse would hardly otherwise have been staged on 6^th March 2012
         2. A representative portfolio of nine cases has been put before the Education Select Committee – as it tries to investigate child ‘protection’.
         3. Thanks to the Daily Mail, Sue Reid uncovered the Cleveland Scandal25 years ago and has been writing exactly like Christopher Booker: with a LOT of substance and evidence: real live people whose families have been destroyed
            1. The result was the introduction of SECRECY into family courts through the Children Act 1989!
            2. In The Times, Camilla Cavendish wrote recently Remove the veil of secrecy from these fakes – So-called expert witnesses in the family courts hold children’s fate in their hands. But they are nothing of the sort.

As Children Minister, I therefore strongly recommend that you make yourself popular by RETURNING all those children wrongfully taken from their parents!

As McKenzie Friends we had our first successes by simply attending meetings with Social Services – and children were returned. But since you don’t seem be motivated to act, we’ll have to teach others how to follow that model.

However, as Children Minister acting in the INTEREST of children, you could

• Undo all previous wrong-doings by
  • removing artificially imposed gags on parents
  • inviting all parents to come forward for an ‘amnesty’ with apologies and compensation
  • Prepare for a better future by
    • implementing Camilla Cavendish’s 10-point plan
    • turning family courts into criminal courts.

At the beginning of a 2-week demo advocating that the Judiciary is Guilty of Criminal Acts… especially in Family Courts, we look very much forward to your prompt response.
